Terms & Conditions – EasyQ

1. Service Description
EasyQ is a business-to-business (B2B) SaaS platform that allows businesses to manage customer queues and flow digitally. The service is intended exclusively for use by businesses and professionals acting in the course of their trade. These Terms do not apply to consumers.
2. Account Registration
Users must:
- Provide accurate and complete information
- Keep login credentials secure and confidential
- Be responsible for all activities carried out under their account
- Be at least 18 years of age and authorized to act on behalf of their organization
3. Use of the Service
Users agree to:
- Use EasyQ in compliance with all applicable laws and regulations
- Not misuse the platform or attempt to circumvent security measures
- Not process unlawful or special-category data without a proper legal basis
- Ensure end customers are informed about the queue management system in accordance with applicable privacy laws
4. Payments and Credits
EasyQ operates on a credit-based model. Credits are purchased in advance and consumed when the platform sends notifications to end customers.
Payments are processed via Stripe. EasyQ does not store or process payment card details.
Credits are non-refundable. Once purchased, credits cannot be reimbursed, transferred, or exchanged, except in the case of a verified technical error attributable solely to EasyQ (e.g., a billing duplicate), which must be reported within 14 days of the charge.
EasyQ reserves the right to modify credit pricing with at least 30 days' advance notice communicated through the platform.
5. Availability of Service
The service is provided "as is" and "as available." EasyQ does not guarantee uninterrupted or error-free operation. Planned maintenance will be communicated where possible with reasonable advance notice.
6. Limitation of Liability
To the maximum extent permitted by law, EasyQ shall not be liable for:
- Indirect or consequential damages
- Loss of profits, revenue, or business opportunities
- Data loss resulting from user actions or third-party services
In any event, EasyQ's total aggregate liability for any claim arising under or in connection with these Terms shall not exceed the total fees paid by the User in the 12 months preceding the claim.
7. Termination
EasyQ reserves the right to suspend or terminate accounts in case of:
- Violation of these Terms
- Unlawful use of the platform
- Non-payment of due amounts
Users may terminate their account at any time via the platform settings. Following termination, user data will be retained for up to 30 days before permanent deletion, during which the user may request an export. After 30 days, all data is irrecoverably deleted.
EasyQ will provide at least 14 days' notice before terminating an account for reasons other than a violation or unlawful use.
8. Intellectual Property
All rights related to the EasyQ platform remain the property of Francesco Pugliese / EasyQ. Users are granted a limited, non-exclusive, non-transferable, revocable license to use the service for their internal business purposes.
9. Data Protection
Users acknowledge that:
- They act as Data Controllers for any personal data of end customers entered into EasyQ
- EasyQ acts as a Data Processor
- Processing is governed by the Data Processing Agreement (DPA) accepted at account creation
Business Users are solely responsible for ensuring they have a lawful basis to process end customer data and to send them WhatsApp notifications through EasyQ.
10. Governing Law and Jurisdiction
These Terms are governed by the laws of Italy. Any dispute arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of Rome, Italy.
Before initiating formal legal proceedings, the parties agree to attempt to resolve any dispute through good-faith negotiation for a period of 30 days.
